There is an article over at Macnn that gives a few good reasons why the bricking may not have been intentional. First they start with a pretty good previous example of Apple’s possible intentions with the iPhone from Apple’s original Mac that had no expansion slots because they wanted to avoid the lockups caused by adding random expansion hardware.

Tim Wu is apparently a pretty smart guy when it comes to copyright laws and he has taken the time to weigh in on iPhone unlocking. He even says he told the Apple employees at the Apple store where he bought his iPhone that he was intending to unlock it and they still continued to sell him the $400+ iPhone.

Yeah, I know this won’t be the first, it won’t even be the first pertaining to the iPhone, but they are trying to get a class action suit together over the new firmware and the lack of warranty service. Little comfort to those who face bricking their unlocked iPhones or languishing on old firmware forever, but the iPhone DevTeam have been pretty unequivocal at accusing Apple of taking the, let's say, AT&T pleasing option when it comes to constructing their upgrade. As they told Gizmodo:

They also marched on to the tune that Apple is being far too restrictive. They said that if the number of downloads of just the iPhone Dev teams unlocking software are any inclination, then several hundred thousand people are running around with unlocked phones. I would hate to be working at the Genius Bar the day after the next iPhone update.
