Another lawsuit is being thrown Apple and AT&T‘s way. Previous lawsuits have included the construction of the devices however this time, it is all about service delivery.

This time, the law is getting involved against Apple and AT&T claiming that the Internet access on the iPhone 3G is too slow. Or at the very least, slow enough to be considered false advertising on Apple’s part. Previous legal papers have been filed against iPhone 3G reception and speed. Through the current legal battle, the presentation of marketing and product information may change.
One part worth noting is that Apple are not supplying or maintaining the infrastructure to which the iPhone relies. Advertising can be a little over to top however the network itself is owned by AT&T. After previous problems relating to reception for the iPhone have been fixed, this seems to be more of a problem for AT&T. Updates and information about the matter will be posted as soon as they come to hand.

Who cares? Apple either wins or settles these suits without a scratch.
In the UK, 3G is well fast…… What are AT&T playing at… I get almost broadband speeds over 3G here.
I live in the suburbs outide of Memphis TN and I am very pleased with the speed and coverage area of AT&Ts 3G reception with my iPhone. I think alot of these people are just trying to cash in over nothing. If you don’t like the phone or it’s reception, take it back, get your money back!! I hate people.
this is great i have been saying this for so long att and iphone is so slow i have a peice of crap phone samsung instinct and its still 2x faster than iphone3g!!! i did the mobile speed tests. and i burned my friend and i only had three bars he had full bars!! sue the pants off them and long live the palm pre nking and ruler of all smart/pda/next gen phones!!!! down with apple lets what the company burn….
Nothing will takedown the iPhone haroid. Not lawyers, not pissed off customers, and certainly not the Pre. The Pre won’t sell anywhere near the units the iPhone has. Apple has too strong of a fan base. Face it, the iPhone and Apple are here to stay for a LONG time. So cry.

hArOlD has the attitude of a clueless young punk that thinks his friends 6 iPhones matter or make a dent to Apple/AT&T. Sure the Pre has good potential to be #2 in the market, this is their marketing ploy. While they no longer have the edge on some features like copy/paste or MMS, the hardware is smaller footprint, and they have support over their apps. But they are also smart enough and have played this game for long enough to know that RIM, Nokia, Google/Android are easier to knock off. Pre is smart for setting their sights on not being #1, and looking to convert some unhappy users on other carriers. As for hAroid, he will be #1 only in his own mind.
@ Cory Gillmore> While the continuing problems might not bring down Apple, or its IPhone currently there are other options that will certainly put a BIG dent in their market share. Googles G1 on the TMobile network is so much faster and the connection much more reliable.
I like you live in the suburbs of Memphis, a bit North, and I have been absolutely disappointed with the terrible network, dropped calls, poor customer service. Overall I am on the verge of getting together the many friends who live in Memphis area to file a class action against AT&T.
I am completely dissatisfied with AT&T and there molasses slow 3G network.
