Class action suit against Apple a possibility





Yeah, I know this won’t be the first, it won’t even be the first pertaining to the iPhone, but they are trying to get a class action suit together over the new firmware and the lack of warranty service. There appears to be two separate groups, the first is all those that did something that might have voided their warranty legitimately, whether it be accessing the iPhone’s flash directly for such things as ringtone hacks (this is class 1).

The second would be those that hacked their iPhones to use 3rd party apps, I would assume this number is huge (this is class 2). Third is for those that actually unlocked their iPhones, and had their warranties voided regardless of whether they restored the iPhone back to its original state before taking it in or not (this is class 3).

From what I gather all three of those are part of one suit. Another suit is slowly growing though, and has a far higher chance of success, this one is for those who didn’t hack their iPhones at all, as in, did nothing to them, but had their warranties voided and presumably their phones blacklisted because they came in after the release of the new firmware with legitimate problems and the people at the Genius Bar weren’t so genius if you will and assumed the problems were because they hacked their iPhones.

    seems like there is no chance in hell for any of these suits. The way American consumer laws are written, users agreed to apple’s terms when they activated and used the iphone for the very first time. This includes the warranty stipulation regarding modification, etc. In america, the land of the free, you can completely sign away your rights by opening a box or installing a piece of software.

    The people that bought the iphone before everyone – the early adopters- have been the core of apple’s booming new market growth. They bought the phone sight unseen, before all the word got out about all the nasty un-apple-like restrictions built into the phone. They got screwed once by apple when apple dropped the price right after they bought it, and they got screwed again when apple bricked their phones with the software update. Apple has, and continues to do, irrepperable harm to this loyal and dedicated audience. “Fool me once, screw me. Fool me twice, screw you.” Now, this extremely influential and media savvy audience of tastemakers is taking their story to the rest of the apple audience, and it’s blowing up in apple’s face. Remember – the apple customer isn’t SUPPOSED to be the mindless zombie consumer who doesn’t know or care if their technology device is intentionally crippled. Looks like the iPod was the end of “Thinking Different”.

    Look at me – they lost me even before the damn thing even came out! Now I’m totally over the apple “glow” effect and I’ll never buy ANYTHING they make before the hackers and crackers have gone over the product with a fine toothed comb and laid out all the hidden bugs and crippleware. We used to joke about not buying anything 1st Gen from Apple – now it’s not so funny.

    Class action suits probably offer better odds than the lotteries, but seem to attract the same type of gambler. What’s next – “I thought the sky should be green so I’m suing Jesus, God and the Holy Spirit…and my priest”?

    Furthermore…Apple aborted OS10.5 (and who knows what else) to bring the iPhone out on schedule. I can well imagine that a major OS release is now something of a priority, leaving little spare capacity for tippytoeing around amateur hackers with a Lohan ringtone fetish and a desperate need to play antique platform games.

    It’s a phone, dogdammit, and I rely upon it for my income. If I wanted a half-asped crash monster, I’d buy a Windows Mobile unit – or a Treo 680.

    My $20 says that 10.5 technology will open up a great deal of iPhone functionality…any takers?

    I am the one who bought early and the desired functionality was not there. I believe that apple is walking a very thin line. If I buy a car and put a turbo charger on it, I void the warranty for the engine and the rest of the power train, but in no way does the auto manufacturer disable the vehicle. I will never buy another apple product ever again. They dropped the price of the unit instead of adding the necessary functionality for other markets to be opened up. I believe that this is very iirresponsible of apple.
