This is not turning out to be a good year for the Apple legal department. They're currently battling Cisco over the right to use the iPhone name. Quantum Research also filed suit against them earlier this year stating that the iPod click wheels infringe on one of their patents. From the looks of things, another one may be on the way.
Quantum Research is considering filing a second suit for patent infringement; this time on the touchscreen used in the upcoming iPhone. They believe that Apple is using a rear-surface touchscreen with a proximity sensor to tell if it is held to the ear. If Apple is using charge transfer technology, (the same technology in question in the iPod click wheel case) then they would again be infringing on a patent. This technology has already been licensed to companies such as Motorola for use in mobile phones.
Although I am sure that this will not be a major setback in the release of the iPhone, it is never good to have two lawsuits going on a product that hasn't even been released yet.
